The Law No. 5/1999 provides a guarantee of legal certainty for stimulating further rapid economic development in an effort to improve social welfare, as well as an implementation of the spirit and intentions of the 1945 Constitution. For an effective implementation of this law and implementing regulations thereof in accordance with its principles and objectives, it is necessary to form a Business Competition Supervisory Commission, i.e. an independent institution free from the influence of the Government and other parties, having the authority to conduct supervision of business competition and to impose sanctions. Such sanctions shall be in the form of administrative measures, whereas criminal sanctions shall be under the authority of the court of justice. Competition in banking is one of our main focused beside merger analysis. Banking in Indonesia is quite competitive market and dominated by 8 (eight) major banks, such as Mandiri, BNI, BCA, etc. This banks covered 80% market share in Indonesia. According to our reading, banking in Indonesia is a monopolistic market, where they are competed with their differentiated products. Rapid competition is accrued in consumption's credit, where price leadership accrued in corporate and investment's credit scheme.
